This illegal action by Cairns City Council has been hurtful, time consuming and costly.

Northern Belle owner Aart Brons says the Cairns City Council’s mishandling of his brothel’s development application was "fraudulent, deceitful and costly". "I’ve been rolled over and screwed by council," Mr Brons said. He has previously called for the Crime and Misconduct Commission to investigate the council’s assessment of his application, which he claims delayed the opening of the brothel by more than five years. Mr Brons said he would meet lawyers from Bottoms English today to launch legal action in a bid to recoup $200,000 in legal fees and up to $200,000 annually over five years in lost revenue. Northern Belle celebrated its first anniversary this week after it opened for business on January 12 last year as the city’s first legal brothel. Mr Brons said his legal case against council was "solid as a rock". "I’m taking them to court because I want to know why certain documents related to my development were withheld from councillors and not included in the planning report," Mr Brons said. "It would’ve made it much easier for councillors to vote on the application if this certain document was included. "There is a broader issue at stake here about how developments are handled by the council. "If they left this important document out of my application when councillors were assessing it, how many other projects have been stopped because of similar handling of applications by council?" A council spokeswoman said similar concerns had previously been raised by Mr Brons and presented to council, with its officers making a "professional judgment" on a case-by-case basis to decide which documents were included and presented to councillors. "It is Mr Brons’ right to take legal action if he chooses to do so, and the council will respond accordingly," the spokeswoman said. Mr Brons said business at Northern Belle had been flat in recent months. "We haven’t made a profit in the first year, which is normal for any business, but our staffing levels are holding up," he said. Aart Brons said the council operated works depot behind his Cava Close, Portsmith, business was causing a huge amount of dust swirling on to his back patio that was used as a staff recreation area. And until the problem was fixed, Mr Brons said he would not pay his rates and had sent the council a $33,000 cleaning bill. "It cannot co-exist," Mr Brons told The Cairns Post. "I will only pay my rates if I am given the service I deserve." A Cairns City Council spokeswoman said the soil and rubble recycling operation was allowable in the area zoned for industrial use. A 10m high dirt barrier between the Northern Belle and the works project had been built and was yet to be landscaped. Mr Brons feared people would climb the barrier and look down into the brothel, which was closed in by 2-3m tall fencing. He also said the grass that was up to 4m high brushing against his fence was not acceptable because it caused a problem with vermin and snakes. "I feel this is sour grapes because we wouldn't go to the quarry so they brought it to us," Mr Brons said. The spokeswoman said the council was already considering moving the recycling operation to a Redden St site, away from the brothel and its neighbouring businesses. "They have been operating a small recycling program which involves putting material such as soil, rubble and concrete there and recycling it so it can be re-used elsewhere," she said. "This is to save costs as well as to prevent it from going into landfill." An Evironmental Protection Agency spokesman said the dust complaint was being investigated. Last month, Mr Brons met with a lawyer to discuss suing the council for mishandling of his brothel's development application. He wanted to recoup the $200,000 of lost profit for each year during the five years the business took to be approved. With these words Cairns City Council chief executive officer David Farmer acknowledged the public and media were excluded from part of last month s council meeting while votes were being taken on the city’s future.

The council will be investigated to find if meeting procedures were followed under the Local Government Act, which requires all voting be held in public.

"Farmer made the admission at a press conference which the council had tried unsuccessfully to keep secret from The Cairns Post yesterday.

At the conference Mr Farmer told media how the council had believed it had voted in an open meeting on March 24, despite closed doors, a sign warning the public to keep out and a security guard preventing entry.

"And there is no doubt that in the process, the administrative process was not as efficient as it should have been," Mr Farmer said.

"The fact is we've been doing this for a number of years and at no point in time has anyone wanted to re-enter the chambers.

"We would have been opening the door to non-existent people going through this strange procedure for a number of years to achieve this outcome."

Local Government Minister Desley Boyle last night said she viewed the allegations of voting in a closed meeting as serious and would thoroughly investigate.

She would be looking at the legality of the minutes recording council's declaring the meeting "open" while it was held in the closed room under guard.

Her office had received two letters of complaint about the council's closed meeting from Cairns residents.

The Crime and Misconduct Commission also confirmed it had received complaints and been asked to investigate the council.

Mr Farmer also denied the council was trying to stifle debate on public issues by prohibiting access to a list of items up for discussion at meetings.

Chapter 6, division 4 of the Act requires a list of items to be discussed at meetings is to be made available to the public at the same time as councillors receive their agenda, which in Cairns is usually a week before the meetings.

The Cairns Post has repeatedly asked for this information but reporters have been denied access to the list since the newspaper published stories alerting ratepayers to what was coming up at meetings.

Local Government Association executive director Greg Hallam said the Local Government Act did not ban councils from limiting public debate by keeping items to be discussed out of the media.

"On the evidence available to us, we don't believe there has been any breach of the Local Government Act at all by the council," Mr Hallam said.

When asked whether an "open" meeting could be truly open with closed doors, a sign prohibiting entry and a staffer guarding the door, Mr Hallam replied: "That would be a matter for a court to interpret."

The CMC complaint, lodged by Gordonvale's Selwyn Johnston, calls for the dismissal of the council and the appointment of an administrator.

Mr Johnston also lodged a complaint with Ms Boyle's office.

A separate submission to Ms Boyle, signed by six residents, asked the minister to investigate whether the council had broken the law with its meeting procedures, why meeting agendas were not openly available for public scrutiny before meetings and to protect the rights of Cairns ratepayers.

LOCAL Government Minister Desley Boyle will warn council chiefs across the state to tighten up their meeting procedures following a five-month investigation into Cairns City Council.

The report found the council routinely breached the Local Government Act, especially in relation to closed meetings.

But Cairns Mayor Kevin Byrne yesterday denied the report had found any wrongdoing at council.

Ms Boyle said: "Council has not been following correct procedures for meetings, particularly relating to closed sessions. It is so important for elected representatives to follow proper process and procedures.

"The community must have confidence that what is being discussed in meetings closed to the public is appropriate."

The probe into council's procedures was sparked in March after The Cairns Post uncovered routine practices which saw the media and the public excluded from part of closed meetings while votes were being taken.

The minister said council chief executive David Farmer had assured her the council had made sweeping changes to ensure it no longer breached the law.

"Nonetheless, I suspect Cairns City Council is not the only council to have strayed from correct procedures," she said.

Cr Byrne denied council had attempted to keep the public from entering meetings or obtaining information they were entitled to.

"There can be no greater damaging allegation made to any corporate body or organisation than to suggest that it is in some way corrupt...," he said. "Now we have been cleared of these allegations of deliberate obstruction of public scrutiny, I intend to continue with the serious business of council's operations in providing a better city.''

CMC might grill council

RESIDENTS are demanding an audit of Cairns City Council minutes following revelations the council breached meeting procedures, which was not reflected in official minutes.

They also plan to lodge a complaint with the Crime and Misconduct Commission over the council's voting on issues in closed meetings.

A former councillor has revealed that illegal votes in closed meetings go back as far as 2000.

The group of nine concerned residents will today lodge a complaint with Local Government Minister Desley Boyle demanding she investigate why council voted on decisions in closed meetings and discussed items not entitled to be kept secret under state law.

Meanwhile, mayoral candidate Val Schier plans to lodge the complaint with the CMC today.

"A letter signed by nine people has been drafted and will be sent to Desley Boyle asking her to investigate the meeting procedures at Cairns City Council," Ms Schier said.

"I will also be asking the CMC to investigate the allegations."

The complaints follow the March 24 meeting at which a security guard kept the public and media out of the closed session while voting took place and even moved media away from the door when they could see councillors voting through a glass panel.

The council risks being sacked if it is found in breach of state laws requiring open meetings on general topics and all voting to be done in public.

Former councillor and current member for Cook Jason O'Brien said the council was told that voting in closed meetings was illegal during his term from 2000 to 2004.
